All athletes are required to fill out a consent form (below) in order to participate. If you are under the age of 18, your parent(s) must fill out the form. There are NO EXCEPTIONS. With out a signed, or filled out consent form, you will not be allowed to participate in the clinic.

The information request below is being used to put a report together for both college coaches and players. The players will receive a copy when event is over. We will post them on our web site for you to download and use. We are also including a section for your high school coaches to add their comments. This information is extremely valuable to college coaches. So it is important that you provide the necessary information. You need to be aware that for Grades, and any test scores, will be checked by the unviersity.

Please read the waiver carefully By checking the box below, you agree, warrant and covenant as follows: ACKNOWLEDGMENT OF RISK, RELEASE OF LIABILITY AND AGREEMENT Our lawyers made us say this...... 1) I am applying for admission to the National Baseball Showcase (NBS) and associated activities being fully aware that these activities involve risks. I accept all the risks of participating, even if they are created by the carelessness or negligence of a Released Party or anyone else. "Risks" include physical exertion, and surface conditions. I know there are other risks too. I am aware that it is advisable to consult a physician prior to participating in the clinic. 2) I fully release, discharge and waive any Claims I may have, now or in the future, against the Released Parties, even if Claims are based on the carelessness or negligence of a Released Party or anyone else. ("Claims" as used in this document means all claims, demands, and legal actions, arising out of damage, injury or death of participant while engaging in the National Baseball Showcase, or any of its associated activities, which I or my heirs or personal representative could make. "Released parties" as used in this document means National Baseball Showcase , high school where activity takes place, City of where the clinic takes place, State of Colorado, all sponsors of the National Baseball Showcase, and the governing bodies, directors, officers, representatives, agents, employees, medical personnel, and volunteer staff of each of them.) 3) I agree not to sue Released Parties for Claims, even if the Claims arise from the carelessness or negligence of a Released Party or anyone else. I agree to indemnify (protect against loss) and hold harmless each Released Party, from any loss or liability (including any reasonable attorneys fees they may incur) defending any Claim made by me or by anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the carelessness or negligence of a Released Party or anyone else. 4) I grant my permission to Biokats Sports Network, BioKats Inc, the sponsors of the National Baseball Showcase and any transferee or licensee of them, to utilize any photographs, motion pictures, videotapes, recordings and any other references or records of the National Baseball Showcase activities which may depict, record, or refer to me for any purpose, including commercial use by National Baseball Showcase, its sponsors and their licensees. 5) I agree to abide by the rules of the National Baseball Showcase. I acknowledge that, if I violate any of these prohibitions or other Rules, I may be removed from the clinic, showcase, combine, or event and the permission for me to participate in the National Baseball Showcase activities may be withdrawn by representatives of National Baseball Showcase . 6) I have fully read and understand the statements I have made by signing this document. No warranties or representations have been made to me about the clinic or activities which are not stated on this form. I understand and intend that this document act as the broadest and most inclusive assumption of risk, waiver, release of liability, agreement not to sue and indemnity as is permitted by the laws of the State of Colorado. If any portion of it is held to be invalid, I agree that the rest of it shall continue in full force and effect. I agree that this agreement was made in Erie, Colorado and that the laws of the State of Colorado shall govern the interpretation and enforcement of this document. 7) I grant National Baseball Showcase permission to act on my behalf in case of a medical emergency for my son/daughter. 8) If the participant is under 18 years of age, the parent agrees to the following statements: As a parent or guardian of the participant, I authorize the child to participate. I also join in the statements and agreements made by the participant in this document. I also agree that in the event participant, or anyone acting on his or her behalf, should make any Claims, I will provide the indemnities described in paragraph 3. 9) I agree to Biokats Sports Network, BioKats Inc. Refund Policy. There are No Refunds. I fully accept the charges to my credit card. You can contact us if you have any questions. 10) I agree that National Baseball Showcase has the right to cancel, move, or adjust the time to any event that is scheduled. 1. Authority to Register and/or to Act as Agent. You represent and warrant to National Baseball Showcase (NBS) that you have full legal authority to complete this event registration on NBS, including full authority to make use of the credit or debit card to which registration fees will be charged. In addition, if you are registering third parties, you represent and warrant that you have been duly authorized to act as agent on behalf of such parties in performing this event registration. By proceeding with this event registration, you agree that the terms of this Registration Agreement shall apply equally to you and to any third parties for whom you are acting as agent. Compliance with Children's Online Privacy Protection Act (COPPA). You represent and warrant that, in compliance with COPPA, you are over thirteen (13) years of age, and that if you are registering a child under fourteen (14) years of age you are the parent of such child, and do hereby consent to the collection of such child's personal information by NBS. 2. Limitation of Liability; Disclaimer of Warranties. ACTIVE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM (A) THE USE OR THE INABILITY TO USE NBS OR (B) FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR (C) RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR TRANSACTIONS ENTERED INTO THROUGH NBS OR (D) RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF ACTIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU EXPRESSLY AGREE THAT USE OF NBS IS AT YOUR SOLE RISK. NBS IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NBS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. NBS makes no warranty that the NBS sites' services will be uninterrupted, secure or error free. NBS does not guarantee the accuracy or completeness of any information in, or provided in connection with, the NBS sites. NBS is not responsible for any errors or omissions, or for the results obtained from the use of such information. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the NBS sites is at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of data that results from the download of such material and/or data. 3. Indemnification. You agree to indemnify and hold each of NBS and its officers and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of NBS or the violation of any term of this Liability Waiver or the NBS Terms of Service by you. 4. Applicable Law; Consent to Jurisdiction. The NBS sites (excluding linked sites) are controlled by NBS from its offices within the State of Colorado, United States of America. By completing this event registration, both you and NBS agree that the statutes and laws of the State of Colorado, without regard to the conflict of laws principles thereof, will apply to all matters relating to this event registration, this Liability Waiver, or other use of the NBS sites. You agree that exclusive jurisdiction for any dispute with NBS resides in the courts of the State of Colorado and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Colorado in connection with any dispute including any claim involving NBS or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers. 5. Severability. If any provision of this Liability Waiver shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Liability Waiver and shall not affect the validity and enforceability of any remaining provisions.
